Welcome to FYV Co (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of https://fyvco.com/ (the “Site”) and our mobile applications (collectively, the “Platform”), as well as all luxury car and villa rental services (the “Services”) provided by FYV Co. By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree, do not use the Platform.
1. Eligibility
To use FYV Co’s Services, you must:
· Be at least 25 years old for car rentals (21+ for select vehicles, subject to additional fees).
· Possess a valid driver’s license and meet our insurance requirements.
· Provide accurate, current, and complete information during account creation and bookings.
We reserve the right to deny access to anyone who violates these criteria or poses a risk to our community.
2. Account Registration
You are responsible for:
· Maintaining the confidentiality of your account credentials.
· All activities under your account, including unauthorized use.
· Promptly updating your profile with changes to payment methods, contact details, or licenses.
FYV Co may suspend or terminate accounts for breaches of these Terms.
3. Booking and Payments
· Reservations: Vehicle and villa availability is subject to change until confirmed.
· Pricing: Rates include base fees, taxes, and mandatory charges. Optional upgrades (e.g., insurance, premium amenities) incur additional costs.
· Payment: Full payment is required for booking. We accept major credit/debit cards and digital wallets.
· Security Deposit: A hold may be placed on your payment method for incidentals or damages.
4. Cancellations and Refunds
· Renter Cancellations:
· Cars: Cancel ≥ 24 hours pre-pickup for a full refund (minus a $50 processing fee).
· Villas: Cancel ≥ 7 days pre-check-in for a 75% refund; cancellations within 7 days forfeit payment.
· FYV Co Cancellations: We may cancel bookings due to safety concerns, fraud, or operational issues with a full refund.
5. Vehicle Rentals
· Use Restrictions: Vehicles must not be used for illegal activities, racing, or off-roading. Mileage limits apply.
· Fuel: Return the vehicle with the same fuel level as pickup.
· Damage Liability: Renters are responsible for repair costs exceeding normal wear and tear.
6. Villa Rentals
· Occupancy: Adhere to the maximum guest limit specified in your booking.
· Check-In/Out: Follow posted times unless prior approval is granted.
· Property Care: Report damages immediately. Unauthorized parties or smoking may incur fines of up to $1,000.
7. Insurance and Liability
· Car Rentals: Basic insurance is included. Upgrade options (e.g., collision damage waivers) are available.
· Villa Rentals: Liability coverage is included; additional protection for valuables is recommended.
· Exclusions: We are not liable for personal injury, lost/stolen items, or third-party claims arising from misuse.
8. Dispute Resolution
· Negotiation: Parties agree to resolve disputes informally via good-faith discussions.
· Arbitration: Unresolved disputes will be settled by binding arbitration under AAA rules, conducted in [Insert State].
